Mediation

Mediation is a voluntary process in which two or more parties work with an impartial third party (mediator) to help them generate potential solutions for their disagreement while working toward the goal of resolving the conflict via a mutually acceptable settlement. At IMSI we do not make decisions for the parties but rather, we utilize specialized negotiating skills to assist the parties in expressing their respective positions, in discussing alternatives and in helping formulate a voluntary solution that is acceptable to both sides. In short, as the mediator we control the negotiating process, not the outcome. IMSI offers mediation services to individuals, attorneys, businesses and any other entities involved in conflict situations.

Arbitration

By contrast, arbitration involves an impartial third party (arbitrator) who listens to both sides, weighs the “evidence” and renders a decision that resolves the dispute in its entirety. Depending upon the desire of the parties or the requirements of applicable contract terms, arbitration can be used to reach a final decision that is “Binding” upon the parties or it can be utilized in a “Non-Binding” manner. A “Non-Binding” arbitration decision may be used as an advisory tool to foster additional discussions that often lead to a voluntary resolution of the conflict at a later date.

IMSI provides arbitration services either by serving as the sole arbiter of disputes or as one member of a three member panel depending either upon the preferences of the parties or as mandated by contract terms.

Hybrid Services

As mediation and arbitration continue to evolve, combinations of the mediation and arbitration models are starting to emerge. Mediation and arbitration can be combined to provide additional conflict resolution options for parties in conflict. IMSI offers these hybrid services in addition to traditional mediation and arbitration models. Please contact us for more information regarding these unique options.
